1. Agreement to these terms
These Terms of Service (the terms) govern your use of homebackupco.com (the site) and any purchase you make from homebackupco LLC, doing business as Home Backup Co (we, us, our). By using the site or placing an order, you agree to these terms, our Shipping Policy, Returns & Refunds Policy, Warranty and Privacy Policy, which are part of these terms.
If you don’t agree, please don’t use the site or place an order.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to buy from us. We sell to customers for delivery within the contiguous United States and Washington, D.C.
3. Your account
You can check out as a guest or create an account. If you create one, keep your password confidential and let us know right away if you believe your account has been used without your permission. You’re responsible for activity under your account.
4. Products and descriptions
Every product we sell is new. We take care to describe products accurately using information from the manufacturer. Specifications, features and included accessories are set by the manufacturer and may change without notice.
Product photos are for illustration. Colors, labels and packaging may differ slightly from what you receive. Runtime, charging time and output figures are manufacturer estimates; real-world results depend on your appliances, conditions and settings.
Brand names such as Anker SOLIX, EcoFlow, Renogy, EG4 and others are trademarks of their respective owners. Home Backup Co is an independent retailer, and use of these names doesn’t imply endorsement or affiliation unless we state otherwise.
5. Prices and errors
All prices are in U.S. dollars. Prices and availability can change at any time before you place an order.
Despite our care, a product may occasionally be listed with an incorrect price, description or availability. If we find an error after you order, we’ll contact you and give you the choice to continue at the correct price or cancel with a full refund. We reserve the right to correct errors and to cancel orders affected by them.
6. Orders and acceptance
Your order is an offer to buy. You’ll receive an email confirming that we’ve received it; this confirmation isn’t acceptance. A contract is formed when we ship the product to you.
We may refuse or cancel an order, or limit quantities, for reasons including product availability, pricing or description errors, shipping restrictions (for example, items that can’t be shipped to California), or suspected fraud. If we cancel an order you’ve paid for, we’ll refund you in full.
You can cancel your order free of charge before it ships by emailing support@homebackupco.com.
7. Payment
Payment is due when you place your order. Payments are processed securely by our third-party payment processor; we don’t store your full card number. By submitting payment, you confirm you’re authorized to use the payment method.
8. Shipping, title and risk of loss
Shipping terms, costs and delivery times are set out in our Shipping Policy. Title and risk of loss pass to you when the product is delivered to your shipping address. If a package is lost or damaged before delivery, we’ll replace or refund it as described in the Shipping Policy.
9. Returns, refunds and warranty
You can return items within 30 days of receiving them under our Returns & Refunds Policy. Every product is covered by its manufacturer’s warranty, as described on our Warranty page.
10. Safe installation and use
Backup power equipment stores and delivers large amounts of energy. You agree to install and use every product according to the manufacturer’s instructions, warnings and ratings, and according to applicable electrical, building and fire codes.
- Connecting any equipment to your home’s electrical panel, including transfer switches, inlet boxes, smart panels, inverters and battery systems, must be done by a licensed electrician and may require a permit and inspection.
- Connecting equipment to the utility grid, including solar systems that export power, may require approval from your utility before operation.
- Never run a gasoline, propane or dual-fuel generator indoors, in a garage, or in any enclosed or partly enclosed space. Carbon monoxide can kill. Follow the manufacturer’s placement distances.
- Store and charge lithium batteries within their rated temperature range, away from heat sources and flammable materials.
- Backup power products are not a substitute for a medical-grade power supply. If you rely on powered medical equipment, have a plan that doesn’t depend on a single device.
11. Regulatory restrictions
Some products are subject to local rules. For example, generators that aren’t CARB-approved can’t be shipped to California. You’re responsible for complying with permits, codes, homeowner association rules and utility requirements that apply where you live.
12. Using the site
You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with its operation, scraping it with automated tools in a way that burdens it, placing fraudulent orders, or using it for any unlawful purpose.
13. Intellectual property
The site’s design, text, graphics, logos and code, other than manufacturer content and trademarks, belong to homebackupco LLC and are protected by law. You may view and print pages for personal, non-commercial use. Any other use requires our written permission.
14. Reviews and submissions
If you submit a product review, question or other content, you confirm it’s honest and your own, and you give us a non-exclusive, royalty-free license to display it on the site. We may decline or remove content that is false, offensive, unlawful or unrelated to the product.
15. Third-party links and services
The site may link to manufacturer websites, manuals and other third-party resources. We don’t control them and aren’t responsible for their content or practices.
16. Disclaimers
Except for the manufacturer warranties described on our Warranty page and any rights that can’t be excluded by law, the site and its content are provided as is. We don’t warrant that the site will be uninterrupted or error-free. Information on the site, including sizing estimates and buying guides, is general guidance and not professional electrical advice.
17. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from a product, an order or your use of the site is limited to the amount you paid for the product or order involved. We’re not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or data, even if we were told they were possible.
Nothing in these terms excludes or limits liability that can’t be excluded or limited under applicable law.
18. Indemnification
You agree to indemnify and hold harmless homebackupco LLC from claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these terms, your misuse of the site, or the installation or use of products in violation of the manufacturer’s instructions or applicable law.
19. Governing law and disputes
These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules.
If you have a concern, please email us first. Most issues can be resolved quickly, and we ask that both sides try in good faith to resolve any dispute informally for 30 days before starting legal proceedings.
Any dispute that isn’t resolved informally will be brought in the state courts located in Van Buren County, Michigan, or the United States District Court for the Western District of Michigan, and you and we consent to their jurisdiction. Either party may bring an eligible claim in small claims court instead.
20. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they were last changed. The terms in effect when you place an order apply to that order.
21. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn’t a waiver. You may not assign these terms without our consent. These terms, together with the policies they reference, are the entire agreement between you and us about the site and your purchases.
